Bankruptcy & Creditors' Rights

Sophisticated Counsel in Challenging Circumstances

In bankruptcy and insolvency matters, our attorneys represent corporate debtors, lenders, unsecured creditors, chapter 7 and 11 trustees, utilities, purchasers, and other parties in interest.  MacDonald Illig also represents clients' interests under all chapters of the bankruptcy code - chapter 7 (creditor only), chapter 13 (creditor only), chapter 11 (creditor and corporate debtor), and chapter 12 (creditor only).  Our Bankruptcy & Creditors' Rights Practice Group regularly advises clients on a range of bankruptcy-related matters including, bankruptcy planning, cash collateral and adequate protection disputes, secured financing, restructuring, bankruptcy mediation, purchasing assets out of bankruptcy, relief from stay, objections to discharge and dischargeability of debts, avoidance actions such as preferences and fraudulent conveyances, and plan confirmation disputes.

In state court matters, MacDonald Illig represents corporate debtors, lenders, and judgment creditors.  This representation can also involve a wide range of matters including consumer and commercial debt collections, consumer and commercial foreclosure actions, out-of-court workouts, receivership matters, and UCC Article 9 sales.
