Defense Verdict in McKean County Arbitration

Attorney Decker recently won a defense verdict in a Landlord/Tenant civil action in McKean County.

The plaintiff tenant alleged permanent injuries to her hand as a result of a window that had fallen on it in the defendant landlord’s apartment.  The plaintiff claimed the Landlord was negligent for failing to inspect and discover the allegedly defective condition.

The defense argued the plaintiff failed to prove notice of any defective condition. The window had been used previously by the plaintiff without any difficulties, and the premises were subject to annual inspection by the local housing authority, which did not cite any violations or defects with the windows.
