Lewis v. Erie Insurance Exchange, 793 A.2d 739 (Pa. Super 2002)
Very important Pennsylvania Supreme Court decision regarding the uninsured (UM) and underinsured (UIM) provisions of the Pennsylvania Motor Vehicle Financial Responsibility Law (MVFRL), 75 Pa. C.S.A. 1701 et seq.
The court held that a policyholder's election of reduced UM/UIM coverages is enforceable even if the election is made on a waiver form that would not be adequate for complete waiver of coverage. The case examines the interplay between sections 1731 and 1734 of the MVFRL.
