Pennsylvania Superior Court Rules That Sellers and Agents Need Not Disclose Murder/Suicide in House

The Superior Court of Pennsylvania in a recent ruling held that neither sellers nor their agent have any duty to disclose to a buyer that a murder/suicide occurred at the property. The Pennsylvania intermediate appellate court held in Milliken v. Jacono, et al. that Pennsylvania law, including the Real Estate Disclosure Law, did not require that the sellers or their real estate agent disclose this type of "psychological" damage, but had only a duty to disclose physical type damages (e.g., roof leak, septic problem, etc.).

The Pennsylvania Supreme Court agreed to hear the appeal of that decision.
