Decker Wins Nonsuit in Civil Trial
Bruce L. Decker, Jr., a partner in the MacDonald Illig Litigation practice group, recently secured a nonsuit for the defense in a civil jury trial which took place in the Court of Common Pleas of Erie County, Pennsylvania in April, 2010. The plaintiff claimed physical and mental injuries after an encounter with a store clerk who allegedly flashed an L.E.D. bar code scanner in her direction. The trial Judge dismissed the lawsuit at the conclusion of the plaintiff's case due to insufficient evidence to substantiate causation of the alleged injuries and entered a nonsuit in favor of the retail establishment.
