Defense Verdict in Erie County Arbitration

Attorney Decker recently secured a defense verdict for a commercial client in an Erie County compulsory arbitration, in which awards up to $50,000 may be entered.

The plaintiff alleged that she tripped over a carpet bunched up by a deliveryman pushing a cart through an aisle.  The plaintiff claimed injuries to her neck, shoulder and ankle as well as dental injuries.

The commercial retail defendant argued that it did not have sufficient notice of the alleged condition and that the plaintiff was contributorily negligent.

The panel returned a verdict in favor of the defendant on all counts.
