Joinder Complaint Against Transit Authority Dismissed

Attorney Decker recently secured the dismissal of a local Transit Authority who had been joined as an additional defendant.  The plaintiff was exiting a Transit Authority bus when he was struck and killed by another motorist.  The plaintiff's estate filed suit against the motorist and the local municipality.  The Municipality joined the Transit Authority as an additional defendant to the lawsuit.

Attorney Decker argued that the Transit Authority was entitled to the governmental immunity under the Political Subdivision Tort Claims Act because the claim did not meet the requirements of the motor vehicle exception to immunity.  The Court agreed and dismissed both the Municipality's Joinder Complaint and the motorist's cross claim.
