Tom Pendleton successfully represented a candidate for a school board who had been nominated as one of five candidates by the voters in her political party in the primary election. Two weeks before the general election, she discovered that the Board of Elections had omitted her name from the general election ballot. Acting on short notice, Attorney Pendleton presented a Petition in the Erie County Court of Common Pleas and a related Petition in the Warren County Court of Common Pleas to have the ballot corrected. The judges in both Erie County and Warren County ordered that the ballot be corrected and that the general election in the impacted precincts proceed by paper ballot, not electronic ballot. After being placed on the paper ballot, the candidate was elected to the school board by more than 200 votes.
