Defense Verdict in Erie Country Compulsory Arbitration

Atty. Decker recently won a defense verdict for a commercial client in an Erie County compulsory arbitration.

Plaintiff alleged she sustained permanent injuries to her elbow and forearm after falling on dangerous black ice in the defendant's parking lot.  Plaintiff included a claim for surgical scarring and medical expenses.

The property owner countered that the injuries were the result of an unfortunate weather-related accident, not due to any negligence in the maintenance of the lot.  The lot was routinely inspected and had been plowed and salted earlier on the day of the accident.

The arbitration panel returned a verdict in favor of the property owner on all counts.
