Favorable Award Entered in Arbitration

Attorney Bruce Decker recently secured a favorable verdict for his client in an arbitration in Erie County, which has compulsory arbitration limits of $50,000.  In April of 2012, the client was involved in a rear end collision with the plaintiffs on Interchange Road near Interstate 79.  The defense admitted liability, but contested the damages claimed by the plaintiffs, who alleged significant neck, back and shoulder injuries.  The defense argued that the plaintiffs’ own medical providers questioned the cause of the plaintiffs’ injuries.  The defense also noted the minimal property damage to the vehicles, the lack of initial treatment, and a significant preexisting medical condition.  The arbitration panel returned an award of zero for one plaintiff and an award less than the settlement offer for the second plaintiff.
