Under Title IX, does "on the basis of sex" include sexual orientation or sexual identity?
Yes. Under the United States Supreme Court's decision in Bostock v. Clayton County, "on the basis of sex" does include a student's sexual orientation and gender identity. Therefore, procedures and practices must be protective of the student's gender identity and sexual orientation.
